Kejriwal to Challenge Delhi HC’s Decision in Supreme Court Over Excise Policy Arrest: Delhi Chief Minister Arvind Kejriwal is set to take his legal battle to the Supreme Court following the Delhi High Court’s dismissal of his plea against the Enforcement Directorate (ED)’s arrest in the Excise Policy money laundering case. Sources indicate that the Aam Aadmi Party (AAP) is not in agreement with the decision of the Delhi High Court.

The Delhi High Court’s decision, rendered by Justice Swarna Kanta Sharma, concluded that Kejriwal’s arrest is not against the law and cannot be deemed illegal. The court noted that the ED had sufficient evidence to justify Kejriwal’s arrest, emphasizing his non-cooperation with the investigation and the impact of delays on those in judicial custody.

According to material gathered by the Enforcement Directorate, Kejriwal was actively involved in the use and concealment of proceeds of crime, both in his personal capacity and as the convenor of the Aam Aadmi Party. The court stressed that the timing of the arrest should be examined according to legal standards, rather than in relation to election schedules, dismissing Kejriwal’s challenge to the timing of his arrest before the general elections.

Arvind Kejriwal was arrested by the Enforcement Directorate on March 21 in connection with the excise policy case. The trial court subsequently remanded him to judicial custody until April 15, 2024. The ED alleges that the Aam Aadmi Party (AAP) benefitted significantly from the proceeds of the alleged liquor scam and accuses Kejriwal of direct involvement in formulating the excise policy.

The case revolves around alleged irregularities and money laundering in framing and implementing the Delhi Excise Policy 2022, which was later annulled. Despite the setback in the Delhi High Court, Kejriwal is determined to challenge the decision in the Supreme Court as the legal battle continues to unfold.
