A Public Interest Litigation (PIL) has been lodged in the Delhi High Court urging facilitation for Chief Minister Arvind Kejriwal to conduct video conferences with his cabinet ministers and MLAs while in custody.

The petition, filed by Shrikant Prasad, appeals for arrangements enabling efficient governance of Delhi, emphasizing that neither the Indian Constitution nor any law bars ministers, including the Chief Minister, from governing while in judicial custody.

Recently, the Delhi High Court dismissed three PILs aimed at removing Kejriwal from his position as Chief Minister, imposing a fine of Rs 50,000 on the petitioner of the third plea, admonishing against frivolous litigation.

Justices Manmohan and Manmeet Pritam Singh Arora expressed displeasure with the petitioner, remarking that decisions regarding such matters lie with the Governor, cautioning against politicizing the judicial process.

A former Delhi Cabinet Minister has also filed a petition seeking Kejriwal’s removal as Chief Minister, alleging his incapacity following arrest by the Enforcement Directorate in an excise policy case.

Kejriwal’s arrest on March 21 pertained to the excise policy case, with the trial court extending his judicial custody till April 23, 2024. The Enforcement Directorate alleges AAP’s involvement in a liquor scam, portraying the party as a major beneficiary of illicit proceeds.
